Terms and Conditions of Sale

Agreement to These Terms

These Terms and Conditions of Sale (“Terms”) apply to everything you buy from Melting Matters, LLC (“Melting Matters,” “we,” “us”). They cover ready-made items and custom work, whether you order through meltingmatters.com, a Square checkout link, social media, by message, or in person.

By placing an order, paying a deposit, approving a custom design, or accepting delivery, you agree to these Terms. Please read Section 7 (Limited Warranty) and Section 8 (Limitation of Liability) closely, because they limit what we’re responsible for.

“Custom work” means anything we design, modify, size, personalize, or make to your request or specifications, including the design work itself. Everything else is a “ready-made” item.

You must be at least 18 to place an order, or have a parent or guardian order for you.

1 Our Products

Every Melting Matters item is made in small batches — by hand, on 3D printers, or by casting and molding — so small variations are normal and are not defects. These include:

  • visible layer lines, support marks, or seams
  • small surface marks, flow lines, or tiny bubbles in resin or cast pieces
  • slight color or finish differences between pieces, or from what you see on your screen
  • small differences in size or weight from piece to piece

Unless a listing says an item is one of a kind, photos show a representative example. Listed sizes are approximate unless your written quote states a specific measurement.

2 Intended Use, Warnings, and Material Limits

Unless a product listing or your written quote specifically says otherwise, these limits apply to every product we sell.

  • Food contact. Only items whose listing says they’re made for food contact, such as our cookie cutters, should touch food. Our other products can hold wrapped candy or packaged food, but don’t let them touch unwrapped food or drink, and don’t put them in your mouth.
  • Cookie cutters and other food-contact items. These are made for brief contact with dough and similar foods. Printed surfaces have tiny ridges that can trap bacteria, so wash them by hand in warm, soapy water before and after each use. Don’t put them in the dishwasher or hot water, don’t use them with raw meat, and don’t store food in them. Replace any that crack or show wear.
  • Heat-sensitive. Plastics and resins can soften, warp, or melt with heat, and they can burn. Keep products out of hot cars, dishwashers, and long direct sun, and away from stoves, heaters, and open flames.
  • Not toys. Our products aren’t designed or tested as toys or children’s products and aren’t intended for children 12 and under. Some have small parts that can be a choking hazard, so keep them away from young children and pets.
  • Not for safety-critical use. Don’t use our products where a failure could hurt someone, such as holding body weight, securing loads, or as safety, medical, or vehicle equipment.
  • Not certified. Our products aren’t tested or certified to any industry, building, electrical, plumbing, HVAC, automotive, or safety code or standard, including UL.
  • Indoors, mild cleaning. Sunlight, weather, chemicals, and solvents can fade, weaken, or damage many materials. Use products indoors and clean them with mild soap and water only.
  • Plated and metal finishes. Plated, painted, and metal finishes can wear, tarnish, or discolor with handling, moisture, sweat, and lotions. Plated items may contain nickel or other metals that irritate sensitive skin, and they aren’t guaranteed hypoallergenic.
  • Lighting and electronics. Use only the light source and power supply we include or specify. Use LED light sources only — incandescent and halogen bulbs run hot enough to damage plastic and resin. Don’t modify wiring, keep electronics away from water, and don’t leave lights on unattended for long periods.
  • Accessibility and assistive items. These are made to help with everyday tasks. They aren’t medical devices and aren’t designed to bear body weight, prevent falls, or replace equipment a medical professional prescribed.
  • Warnings and care instructions. Follow any warnings, labels, and care instructions that come with a product or appear in its listing.

Using a product outside these limits is at your own risk (see Section 9).

3 Orders, Pricing, and Payment

Prices are in US dollars, and we collect sales tax where the law requires it. Ready-made items are paid in full at checkout, and card payments are processed by Square.

  • Check your order. Before you pay, confirm the item, size, color, quantity, personalization, and shipping address. We make and ship what you order.
  • One-of-a-kind items. If more than one person pays for the same one-of-a-kind or last-in-stock item, the first completed payment gets it. Everyone else gets a full refund.
  • Our right to cancel. We may refuse or cancel any order — for example, because of a pricing or listing error, suspected fraud, or because we can’t make or source an item. If we cancel, we refund what you paid for the canceled items.
  • Custom work has its own deposit and payment rules in Section 4.

4 Custom Work

Custom work is made to your request, so these extra rules apply on top of the rest of these Terms.

4.1 Quotes. Quotes are based on the information you give us and are good for 14 days. Changes to the size, design, material, quantity, or deadline can change the price and timeline.

4.2 Deposits and payment. We start custom work after we receive a deposit of 50% of the quoted price, or full payment for orders under $50, which then counts as the deposit. The deposit covers design time and materials and becomes non-refundable once work begins. The balance is due before your order ships.

4.3 Your measurements and information. You’re responsible for the accuracy of everything you give us, including measurements, part numbers, photos, files, colors, spelling, and names. We make custom work to that information. We aren’t responsible for fit, function, or compatibility problems caused by information that was wrong or incomplete.

4.4 Proofs and approval. For many custom orders, we’ll send a render, mockup, photo, or test print for your approval. Your approval by text, email, or message confirms the design, size, spelling, and colors. Changes after approval may cost extra and delay your order.

4.5 Parts that must fit or work with something else. For replacement parts, adapters, mounts, brackets, enclosures, and other parts that must fit something we don’t have, we make the part to the agreed specifications. We can’t test it in your equipment, so we can’t guarantee it will fit or perform in your setup. Before relying on it, test-fit and inspect it and confirm it’s suitable and safe for your use.

We can make a test-fit print first for an added fee — it’s the best way to avoid surprises. The limits in Section 2 also apply to custom parts.

4.6 Items you send us. If you send us an item to measure, match, copy, or repair, you ship it at your own risk, so insure it if it matters to you. We take reasonable care, but we aren’t responsible for wear or damage during measuring, test-fitting, or return shipping.

4.7 Timelines. Completion and ship dates are good-faith estimates based on our current workload. They assume you answer our questions and approve proofs promptly, so time spent waiting on you moves the date by the same amount. If you have a firm deadline, tell us before you order; if we miss the date we gave you, Section 5 (“Delays”) explains your options.

4.8 Material you provide. If you send us a design, file, image, logo, name, character, or other material, you confirm you own it or have permission to use it. That includes permission for us to reproduce it. We may decline any request we believe could infringe someone else’s rights, or that we’re not comfortable making, and Section 10 covers claims arising from material you provide.

4.9 Who owns the designs. You own the physical item you buy. We own the designs we create, including those made for your order. That includes their mechanisms, functional features, 3D models, design files, molds, and tooling, and all rights in them, such as copyright. Paying for a custom order or design time, or approving a proof, doesn’t transfer those rights to you. Only a written agreement signed by us can transfer them.

You keep the rights to anything you give us, such as your logo, artwork, photos, or files. Without your permission, we won’t sell anyone else a design personalized for you (with your name, logo, or likeness) or based on artwork you gave us. We may reuse general shapes, mechanisms, techniques, and non-personal design elements. Without our written permission, you may not copy, scan, mold, or otherwise reproduce any design we created or any piece made from it. If we agree in writing to give you design files, they’re for your personal use only and are non-refundable once sent.

Exclusive production. Instead of charging an added fee to transfer a design’s rights, we keep the exclusive right to produce products made from it, including in quantity for resale. If you want more made, we make them under a separate production quote.

If you need more units or a faster schedule than our current operations can handle, we’ll consider in good faith licensing the design for a royalty on each unit sold, or selling you the design rights outright. Any license or buyout requires a separate written agreement signed by both of us.

Your own products and designs. If you hire us to make a mold, copy, or reproduction of a product or design that already exists and belongs to you, the design stays yours. You may cast, use, and sell parts from that mold with no royalty, and our exclusive production right doesn’t apply. We won’t use your design or mold for anyone else without your permission.

4.10 Photos of your piece. We may photograph custom pieces for our website and social media, leaving out your name and personal details. If you’d rather we didn’t share yours, tell us when you order.

4.11 Cancellations and abandoned orders. You can cancel custom work before we start for a full refund; once work begins, the deposit is non-refundable. If you don’t pay the balance on a finished order within 30 days after we’ve notified you twice that it’s ready, we may treat it as abandoned. We’ll keep any payments made and may sell, reuse, or recycle the item, and items you sent us for the job may be disposed of on the same timeline.

4.12 Final sale. Custom work can’t be returned or exchanged unless it has a defect covered by our Limited Warranty (Section 7).

5 Shipping and Delivery

We ship from Newberry, SC, to the address you give us, and we deliver locally within 15 miles of our shop in Newberry. Delivery dates are estimates, and carrier delays are outside our control.

  • Delays. If we can’t ship or deliver by the date we gave you, we’ll let you know before that date. If we didn’t give a date, the same applies at 30 days after we have your payment and everything we need to fill your order. Either way, you can agree to a new date or cancel for a full refund of everything you’ve paid, including any deposit.
  • Wrong addresses. Double-check your address before you pay. If a package comes back because of an address error on your end, we’ll reship it once you pay the new postage.
  • Delivered packages. Once tracking shows a package delivered to the address you gave us, we aren’t responsible for loss or theft. Contact the carrier first, and we’ll share our tracking records to help. For valuable orders, choose signature confirmation (extra cost).
  • Lost in transit. If tracking never shows delivery, contact us within 30 days of the ship date. We’ll file a claim with the carrier and replace or refund the item once the carrier confirms it’s lost.
  • Shipping damage. Inspect your order when it arrives and report any damage within 7 days of delivery. Send photos of the item, the box, and the shipping label, and keep all packaging until the issue is settled.
  • Local delivery. For addresses within 15 miles of our shop, we’ll arrange a delivery time with you. Once we hand your order to you, or leave it where you asked us to, it’s your responsibility. Check it when it arrives and report any damage within 7 days.

6 Returns, Exchanges, and Cancellations

Unused ready-made items can be returned within 14 days of delivery; custom work is final sale.

  • Ready-made returns. Message us first for return instructions. The item must be unused, undamaged, and in its original packaging. You pay return shipping, and original shipping charges aren’t refundable.
  • Refunds. We refund the item price to your original payment method within 10 business days after we receive and inspect the return.
  • What we can’t take back. Items that have been used, damaged, modified, painted, glued, or sanded; jewelry that has been worn; and items marked final sale.
  • Exchanges. We don’t do direct exchanges. Return the item under this policy and place a new order.
  • Canceling a ready-made order. You can cancel before it ships for a full refund. After it ships, this return policy applies.
  • Damaged or defective items are covered by Section 5 (shipping damage) and Section 7 (Limited Warranty), not this return policy. Custom work follows Section 4.12.

7 Limited Warranty

For 30 days from delivery, we warrant that each product will be free from defects in materials and workmanship when used as described in these Terms. This Limited Warranty covers the original buyer and anyone who received the item from them as a gift.

What we’ll do. If a product has a covered defect, we will repair it, replace it, or refund what you paid for it — our choice. If we ask you to send the item back, we’ll pay return shipping for a confirmed defect. Repair, replacement, or refund is your only remedy under this warranty.

How to make a claim. Contact Melting Matters, LLC at [email protected] or 152 Clarendon Drive, Newberry, SC 29108, within the 30-day warranty period. Include your order number, a description of the problem, and clear photos, and we’ll reply with next steps.

What’s not covered:

  • the normal variations described in Section 1
  • normal wear and tear, including wear of plated or painted finishes
  • damage from misuse, accidents, drops, neglect, or improper care
  • damage from heat, sunlight, weather, water, chemicals, or solvents
  • use outside the limits in Section 2, or against our warnings or instructions
  • items modified, repaired, painted, or altered by anyone other than us
  • improper installation or assembly
  • fit or function problems caused by measurements, specifications, or files you gave us (Section 4.3)
  • shipping damage not reported within 7 days (Section 5)

IMPLIED WARRANTIES. ANY IMPLIED WARRANTIES THAT APPLY TO OUR PRODUCTS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE 30-DAY PERIOD OF THIS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

DAMAGES. WE ARE NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF THIS WARRANTY OR ANY IMPLIED WARRANTY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

NO OTHER WARRANTIES. THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY WE MAKE. IF YOU BUY A PRODUCT FOR BUSINESS OR COMMERCIAL USE, RATHER THAN PERSONAL, FAMILY, OR HOUSEHOLD USE, IT IS SOLD “AS IS” EXCEPT FOR THIS LIMITED WARRANTY, AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

8 Limitation of Liability

If something goes wrong, our responsibility is capped at what you paid for the item involved.

TO THE FULLEST EXTENT ALLOWED BY LAW:

  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT, CUSTOM WORK, OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE THE CLAIM IS ABOUT.
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES DAMAGE TO OTHER PROPERTY OR EQUIPMENT, LOST PROFITS, LOSS OF USE, AND THE COST OF INSTALLING, REMOVING, OR REPLACING A PRODUCT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
  • THESE LIMITS APPLY TO EVERY TYPE OF CLAIM, WHETHER BASED ON CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY.
  • THESE LIMITS ALSO PROTECT OUR OWNERS, EMPLOYEES, AND CONTRACTORS.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT THE LAW DOES NOT ALLOW TO BE LIMITED, SUCH AS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR, WHERE THE LAW REQUIRES, PERSONAL INJURY.

9 Your Responsibilities and Assumption of Risk

You’re responsible for using our products safely and as intended. That means:

  • following the limits in Section 2 and any warnings or instructions we provide
  • supervising use around children and pets
  • inspecting products before use, and stopping if one is cracked, damaged, or worn
  • deciding whether a product suits your purpose, especially functional and custom parts

If you use a product in a way these Terms or its warnings advise against, or for a purpose it wasn’t made for, you accept the risks of that use. If you resell or give away one of our products, please pass along its warnings and care instructions.

10 Indemnification

To the extent allowed by law, you agree to defend, indemnify, and hold harmless Melting Matters, LLC and its owners, employees, and contractors from claims, damages, losses, and costs (including reasonable attorneys’ fees) arising from:

  • your misuse, modification, or resale of a product
  • your use of a product against these Terms or its warnings
  • designs, files, images, logos, text, measurements, or other material you gave us
  • your violation of these Terms or of anyone else’s rights

11 Problems, Chargebacks, and Disputes

If something goes wrong, contact us first — most problems get fixed quickly that way.

  • Talk to us first. Before filing a chargeback, payment dispute, or lawsuit, you agree to email us at [email protected] with your order number and what happened. You also agree to give us 30 days to make it right.
  • Chargebacks. If you file a chargeback without contacting us first, or for an order delivered as described, we will contest it. We’ll provide our records, including these Terms, your order details, our messages, photos, and tracking. We may also decline future orders.
  • Governing law. South Carolina law governs these Terms, without regard to its conflict-of-law rules, along with applicable federal law.
  • Where disputes are heard. To the extent allowed by law, any lawsuit related to a product or these Terms must be filed in the courts located in Newberry County, South Carolina (including magistrate’s court for small claims), or in the U.S. District Court for the District of South Carolina. You and we consent to those courts’ jurisdiction.
  • Time limit. To the extent allowed by law, any claim related to a product or these Terms must be filed within one year after it arises, or it’s permanently barred.

12 General Terms

These Terms, plus your order confirmation or written quote, are our whole agreement about your purchase.

  • Quotes control. If your written quote conflicts with these Terms, the quote controls for that order.
  • Opinions aren’t warranties. Comments we make in conversation or messages about how a product might hold up or perform are good-faith opinions, not warranties, unless they’re written into your quote or order confirmation.
  • Changes. We may update these Terms from time to time. The version posted when you place your order or approve your quote applies to that order.
  • Events beyond our control. We aren’t responsible for delays or failures caused by things outside our reasonable control. Examples include illness or injury, power or equipment failure, severe weather, carrier problems, and supply shortages.
  • Severability. If a court finds part of these Terms unenforceable, that part is enforced as far as the law allows, and the rest stays in effect.
  • No waiver. If we don’t enforce a term right away, we can still enforce it later.
  • Transfer. We may transfer our rights and duties under these Terms if the business is sold or reorganized, such as into a new company.
